Employment-Based Immigration: very First Preference EB-1

You might be qualified for an employment-based, first-preference visa if you are an alien of amazing ability, are an exceptional professor or researcher, or are a particular international executive or manager. Each occupational classification has specific requirements that need to be fulfilled:

Your petitioning company should be a U.S. company and plan to employ you in a supervisory or executive capability. The petitioner needs to have been doing business in the U.S. for at least 1 year, as a legal entity with a certifying relationship to the entity that used you abroad in a supervisory or executive capacity.

No labor certification is needed.

* Criteria for Demonstrating Extraordinary Ability

In order to demonstrate you have sustained nationwide or worldwide honor which your achievements have been recognized in your field of knowledge, you should either consist of proof of a one-time achievement (significant internationally-recognized award) or 3 of the 10 noted requirements listed below (or comparable proof if any of the requirements do not easily use):

– Evidence of invoice of lesser nationally or globally acknowledged rewards or awards for quality

– Evidence of your subscription in associations in the field which require impressive achievement of their members

– Evidence of released product about you in expert or major trade publications or other major media

– Evidence that you have actually been asked to evaluate the work of others, either individually or on a panel

– Evidence of your initial scientific, scholarly, creative, athletic, or business-related contributions of major significance to the field

– Evidence of your authorship of academic articles in expert or significant trade publications or other significant media

– Evidence that your work has been shown at artistic exhibitions or displays

– Evidence of your efficiency of a leading or critical role in distinguished organizations

– Evidence that you command a high wage or other substantially high remuneration in relation to others in the field

– Evidence of your industrial successes in the performing arts

** Examples of Documentary Evidence That an Individual is an Outstanding Professor or Researcher

In order to show you are an outstanding teacher or scientist, you must consist of proof of 2 of the 6 listed criteria below (or equivalent proof if any of the requirements do not readily apply):

– Evidence of invoice of significant rewards or awards for outstanding achievement

– Evidence of subscription in associations that need their members to show impressive accomplishment

– Evidence of released material in professional publications written by others about the alien’s operate in the scholastic field

– Evidence of participation, either on a panel or separately, as a judge of the work of others in the same or allied scholastic field

Application Process

Extraordinary Ability: You may get yourself by filing a Type I-140, Petition for Alien Worker.

Outstanding Professors and Researchers: Your U.S. company should submit a Kind I-140, referall.us Petition for Alien Worker. As part of the application procedure, your company should be able to demonstrate a continuing ability to pay the used wage since the concern date. Your company may use an annual report, federal tax return, or audited monetary declaration to show a continuing ability to pay your wage.

Multinational Manager or Executive: Your U.S. employer must submit USCIS Form I-140, Petition for Alien Worker. As part of the application process, your company needs to have the ability to show a continuing capability to pay the offered wage since the top priority date. Your company may use a yearly report, federal income tax return, or audited monetary declaration to show a continuing capability to pay your wage.
