The Employment Standards Act (ESA) uses to staff members.
A worker consists of a person who:

Under the ESA, employers are not permitted to treat workers covered by the Act as if they are not workers. If an employer misclassifies a staff member in this way, a work standards officer can issue a notification of conflict that results in a penalty, a prosecution or both versus the employer.
Please note, the ESA provides minimum standards just. Some workers may have higher rights under an employment agreement, collective arrangement, the typical law or other legislation.

How to inform who is an employee
The relationship between an individual and the service (or individual) they are working for identifies whether the individual is a staff member and entitled to defenses under the ESA.
